Legal Malpractice Suit alleges Failure to Prosecute over nearly two decades.

Jackson-area attorney, Michael Todd Crowley, represents the family of a former Mississippi State football player who died in 1991 in a legal malpractice lawsuit (Hinds County Circuit Court Action No. 251-12-548) against attorneys who formerly represented the family in a medical malpractice action that, although filed in 1993, lingered until a Court Ordered Dismissal in 2009. After 19 years from the original suit having been filed by Robert G. Germany and his law firm, the Mississippi Court of Appeals ruled that the former attorneys (now Defendants in a legal malpractice suit) had been dilatory in their handling of the case. In fact, Court records demonstrate that the Circuit Clerk had attempted to dismiss the prior case on four occasions due to failures of Robert G. Germany (and others) to move the case forward.

In the present suit for legal malpractice, against Robert G. Germany and his firm Pittman, Germany, Roberts & Welsh, LLP, the Circuit Court's order states that the defense firm of Brunini, Grantham, Grower & Hewes, PLLC significantly breached ethics and also possesses a substantial conflict of interest in the present suit. Consequently, the Court ruled that Brunini was disqualified from defending Robert Germany and his firm in the present legal malpractice suit. The Court found that Brunini participated in the original suit’s appeal with Robert G. Germany and then sought to defend against the family’s later suit for legal malpractice against Robert Germany and his firm.
