On April 16 of this year, Houston criminal defense attorney Mark Thiessen won another not-guilty verdict for a client with a second DWI in Galveston County, Court of Law No. 2, Cause Number 328141.
The Galveston County Assistant District Attorney (ADA) tried the case with a member of the Texas Highway Patrol as the star witness. According to court documents, the client suffered from insomnia and ADHD. She was allegedly called in for reckless driving on 45-South at exit 518. When the trooper began following her on 518, no documentation of swerving, weaving or speeding was noted, and she used all her signals. He pulled her over for stopping past the stop sign on the street on which she lived. The pictures and measurements revealed the stop sign was 27 feet from the curb.
“The reasonable suspicion was questionable at best. She looked okay for a woman that had just worked 14 hours and suffered from ADHD,” stated Thiessen.
According to court records, the Assistant District Attorney tried to argue that she took Klonopin because she had a prescription, even though she told the officer she only takes it for insomnia. As there was no test, no accident and no problem, the not-guilty verdict was easily delivered. This makes Thiessen’s sixth not-guilty verdict in a row, and the third Texas county attorney to win a not-guilty this year.
