Highlights of selected legislation covered in the newly developed protocol include:
- "Regulation (EU) 2017/852 of the European Parliament and of the Council of 17 May 2017 on mercury, and repealing Regulation (EC) No 1102/2008 (Regulation (EU) 2017/852, OJ L 137/1, 24 May 2017), 17 May 2017" sets forth requirements for the temporary storage and disposal of mercury waste. Requirements related to operators of chloralkali manufacturing processes, the cleaning of natural gas, non-ferrous mining and smelting operations and extraction from cinnabar ore as industry specific are not covered in this protocol.
- "Commission Implementing Regulation (EU) 2018/2066 of 19 December 2018 on the monitoring and reporting of greenhouse gas emissions pursuant to Directive 2003/87/EC of the European Parliament and of the Council and amending Commission Regulation (EU) No 601/2012 (Regulation (EU) 2018/2066, OJ L 334, 31 December 2018), 19 December 2018" lays down rules for the monitoring and reporting of greenhouse gas emissions and activity data pursuant to "Directive 2003/87/EC" in the trading period of the Union emissions trading system commencing on 1 January 2021 and subsequent trading periods. It applies to the monitoring and reporting of greenhouse gas emissions specified in relation to the activities listed in "Annex I to Directive 2003/87/EC" and activity data from stationary installations, from aviation activities and to the monitoring and reporting of tonne-kilometre data from aviation activities. It applies to emissions and activity data occurring from 1 January 2021.
- As a result of repeal of two federal laws—"Law of 26 March 1971 on Protection of Surface Water and Royal Decree of 3 August 1976, Regulation on Discharge of Wastewater into Surface Waters and Public Sewers—requirements for wastewater discharges" are now addressed in the regional laws, i.e. "Decree of the Flemish Government of 18 July 2003 concerning integrated water policy, consolidated on 15 June 2018 and Executive Decree of the Flemish government of 1 June 1995 on the General and Sectoral Provisions Regarding Environmental Hygiene (VLAREM II) as last amended by Executive Decree of the Flemish government of 21 September 2018."
- "Royal Decree of 13 March 1998 on the Storage of Flammable and Combustible Liquids" was repealed and provisions related to above and underground storage tanks such as construction, tank filling and supervision requirements were replaced by the "Code of 28 April 2017 on well-being of workers, B.S./M.B. 2 June 2017, as amended."
- The "Code of 28 April 2017 on Well-being of Workers, B.S./M.B. 2 June 2017, (Codex van 28 april 2017 over welzijn op het werk), as last amended by the Royal Decree of 16 September 2018 modifying the Code on well-being for workers" addresses health and safety requirements applicable to all workplaces and industry specific requirements. This Code codified and repealed multiple health and safety Royal Decrees.
- "European Agreement Concerning the International Carriage of Dangerous Goods by Road (ADR), 30 September 1957, as amended (effective 1 January 2019) (ADR 2019), 30 September 1957 as amended through 1 January 2019" applies in Belgium.
- "Royal Decree of 4 April 2019 on the placing on the market and use of biocides, B.S./M.B. 23 April 2019" sets forth requirements for operations using pesticides. .
