As da Vinci robot lawsuits involving Intuitive Surgical’s da Vinci Surgical System continue to mount, Bernstein Liebhard LLP notes that the Massachusetts’ Bay State Board of Registration in Medicine has issued a new advisory for robotic assisted surgery.* According to the alert, the Board chose to act after it received an increasing number of reports of patient complications associated with robot-assisted surgery in the past two years.* While the alert doesn’t specifically mention da Vinci robotic surgery complications, according to a report from MassDevice.com, the Da Vinci robot is the market leader in robotic surgery procedures, with about 367,000 U.S. operations performed in 2012.**

Da Vinci Surgical Robot Lawsuits
According to a report from Bloombeg.com, at least 10 da Vinci robot lawsuits have been filed in the past 15 months on behalf of individuals who allegedly suffered serious da Vinci robotic surgery complications, including organ damage, punctured blood vessels, and surgical burns. *** The Massachusetts advisory details a number of robotic surgery complications, including bowel and ureter damage, and one case in which rectal tissue was accidently left in the abdomen. The advisory further points out that while robotic surgery procedures have increased greatly in the last decade, large-scale, high quality, prospective studies of the risks and benefits of robotic surgery as compared to laparoscopic and open procedures have not been carried out. The risks of robot-assisted surgery should be fully explained to patients, and they should be provided with information regarding the amount of experience a surgeon has in performing a particular robotic procedure, the Board’s statement said.

According to Bernstein Liebhard LLP, Massachusetts’ Bay State Board of Registration is just the most recent group to take notice of an apparent rise in complications associated with robotic surgery. In January, the FDA launched a survey of hospitals that asked doctors who had used the da Vinci Surgical System to list any da Vinci surgery complications they may have seen. The survey is being conducted to determine if an upsurge in adverse event reports associated with da Vinci procedures is related to a problem with the technology. ****

Last week, the American Congress of Obstetricians and Gynecologists (ACOG) advised its members that robot-assisted hysterectomy should not be a first choice for women who need the procedure. Among other things, the group cited the technology’s increased learning curve, during which there is a higher complication rate.*****
