Bernstein Liebhard LLP notes that court documents indicate Intuitive Surgical, the manufacturer of the da Vinci Surgical System, has asked a federal judge in California to coordinate 11 state and federal da Vinci robot lawsuits, all of which allege personal injuries caused by the robotic surgery system. According to the company’s petition dated February 19th, four da Vinci robot lawsuits are already being coordinated before one judge in the U.S. District Court, Northern District of California. Intuitive asserts that each of the additional claims listed in its petition “involves all or a material part of the subject matter” of those actions, and maintains inclusion of the 11 lawsuits in the same coordinated proceeding would avoid conflicting rulings and conserve the resources of the court. Da Vinci Surgical Robot Lawsuits
The da Vinci Surgery System has been on the market since 2000, and is used in a wide range of laparoscopic surgeries, including hysterectomies, gall bladder removal, prostate removal, heart surgeries, and thyroid procedures. According to a report published by Bloomberg.com earlier this month, the da Vinci robot was associated with 70 deaths in informal incident reports sent to the U.S. Food & Drug Administration (FDA) since 2009. Reports to the FDA of possible da Vinci surgery complications have also increased, jumping to at least 115 in 2012 from 24 in 2009, Bloomberg said. In January, the FDA launched a survey of hospitals that asked doctors who had used the technology to list any da Vinci surgery complications they may have seen, in order to determine if the rise in adverse event reports was indicative of a problem with the technology.*

According to a notice entered by Magistrate Judge Daniel E. Knowles III of the U.S. District Court for the Eastern District of Louisiana on March 14th, the Plaintiff in that claim was allegedly injured when the da Vinci robot malfunctioned during a thyroid procedure. Among other things, her da Vinci surgical robot lawsuit accused Intuitive Surgical of failing to adequately maintain the device, and failing to train hospital personnel on the use of and/or the troubleshooting of the device.
