One of the country’s leading defective medical device attorneys, Derek H. Potts, has assumed a key role in ongoing litigation against the manufacturer of the Mentor ObTape Vaginal Sling.

In a September 21 order, the Honorable Clay D. Land appointed Potts to serve as Plaintiffs’ Liaison Counsel and Co-Lead Counsel in the In Re Mentor Corp. ObTape Transobturator Sling Products Liability Litigation (MDL No. 2004).

In this role, Potts will be responsible for leading and coordinating all plaintiffs’ lawsuits filed in U.S. federal courts that are related to the ObTape vaginal sling product. Since December 2008, all Mentor ObTape vaginal sling lawsuits have been consolidated in the U.S. District Court for the Middle District of Georgia for pretrial proceedings.

The claims have been filed by women – and in some cases, their husbands – who claim to have suffered serious injuries after being implanted with the vaginal mesh slings for the treatment of stress urinary incontinence, or SUI.

Potts is the founder and managing partner of The Potts Law Firm, LLP, a Kansas City-headquartered national law firm that represents plaintiffs in complex civil litigation and multidistrict litigation (MDL) cases that involve defective medical devices and dangerous pharmaceuticals.

In a September 14 motion, the plaintiffs asked the court to appoint Potts to head the litigation due to The Potts Law Firm’s “manpower and resources” as well as the Kansas City attorney’s experience as lead and co-lead counsel in several complex civil matters that have resulted in large verdicts and settlements in state and federal courts.

Previously, Potts served as co-lead counsel in the first bellwether jury trial conducted as part of the In Re Kugel Mesh Hernia Patch Products Liability Litigation (MDL Docket No. 07-1842-ML) in the U.S. District Court for the District of Rhode Island. The MDL involved an abdominal mesh product made of material similar to the ObTape product. Potts eventually spearheaded the resolution of nearly 500 cases in the Kugel Mesh MDL.

The Potts Law Firm also has been engaged in several cases currently in the Mentor ObTape Vaginal Sling MDL, and it anticipates filing more cases in the future, the motion stated.

According to the motion, the firm’s work on the case has involved extensive review of discovery materials, including documents previously produced by the California-based Mentor Corporation, as well as the review of information from several experts. Potts also has consulted the Georgia law firm that previously served as lead counsel in the ObTape Vaginal Sling MDL.

“Mr. Potts and other lawyers from his office have diligently worked to review and obtain the information necessary to make them qualified to serve in this capacity,” the plaintiffs wrote.

The Mentor ObTape vaginal sling products have garnered national attention in recent years. Three years after the mesh slings were cleared for the U.S. market by the U.S. Food and Drug Administration (FDA), studies surfaced indicating that women were suffering painful complications linked to the medical device, according to the New York Times.

According to a July 2011 FDA safety communication, thousands of women have reported complications associated with surgical mesh products -- several of which are currently being investigated by The Potts Law Firm.

These complications include mesh erosion through the vagina (exposure, extrusion or protrusion), pain, infection, bleeding, pain during sexual intercourse (dyspareunia), organ perforation and urinary problems, the FDA said. In many cases, these complications have required surgical treatment and hospitalization.
