Mesh Lawsuits Move Forward, as Federal Multidistrict Litigation Prepares for First Bellwether Trials in Ethicon Vaginal Mesh Lawsuits, Bernstein Liebhard LLP Reports

According to a Pretrial Order dated August 5, 2013, the Court has established deadlines for the completion of discovery and other matters pertaining to the first two bellwether trials in the Ethicon mesh litigation. The Order also schedules a Pretrial Conference for January 8, 2014, with the first trial to begin on January 14th. According to court documents, more than 8,640 Ethicon mesh lawsuits are now pending in the proceeding underway in the Southern District of West Virginia. The litigation surrounding transvaginal mesh has been growing since October 2008, when the U.S. Food and Drug Administration (FDA) issued its first of two alerts regarding the high number of complications reported in women who received the devices. In a second alert issued in July 2011, the agency warned that vaginal mesh complications associated with pelvic organ prolapse repair were “not rare,” a change from the position it had previously taken.
