According to court documents, the litigation’s most recent conference was convened on August 14th, after which an Order was issued adopting a pretrial schedule through completion of discovery and filing of opening dispositive motion papers on May 15, 2015. Court records indicate that more than 100 Mirena IUD lawsuits are pending in the litigation underway in the Southern District of New York. All of the claims were filed on behalf of women who allegedly suffered a number of serious Mirena complications following spontaneous migration of the device, including uterine perforations, damage to other organs, infections, scarring, and ectopic pregnancy. Plaintiffs further allege that Bayer Healthcare Pharmaceuticals has a history of downplaying the serious risks associated with Mirena and exaggerating its purported benefits. The next conference in the federal multidistrict litigation is scheduled for September 26, 2013.
According to court documents, more than 180 Mirena lawsuits involving similar allegations are pending in a Multicounty Litigation now underway in New Jersey’s Bergen County Superior Court. The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a contraceptive in 2000, and its approved uses were later expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their primary method of birth control. In 2009, Bayer received an FDA Warning Letter which criticized the company for making misleading claims about the benefits of the IUD and its potential side effects. According to data from the FDA, its adverse event database has received more than 70,000 reports of Mirena complications since the IUD was first brought to market, many of which involved device dislocation and uterine perforation.*
