Stryker Rejuvenate Lawsuits: Bernstein Liebhard LLP Notes Upcoming Case Management Conference in New Jersey Litigation

Bernstein Liebhard LLP notes that the judge overseeing Stryker Rejuvenate lawsuits in a consolidated litigation currently underway in New Jersey’s Bergen County Superior Court has scheduled the litigation’s next case management conference for April 10 at 10 a.m., according to the calendar posted on the court’s website. Court records indicate there were 81 Stryker Rejuvenate lawsuits pending in the New Jersey litigation as of February 20. Claims filed in this litigation were brought on behalf of patients affected by Stryker Orthopaedics’ July 2012 recall of its Rejuvenate and ABG II Modular-Neck Hip Stems. Stryker Rejuvenate Lawsuits
All of the Stryker Rejuvenate lawsuits now pending in the New Jersey litigation were filed on behalf of patients affected by the Stryker hip recall, which was announced by Stryker Orthopaedics on July 6, 2012. The recall was issued after data indicated the potential for the metal stems to fret and corrode at the modular neck junction. In the months following the recall, the company has advised that patients implanted with the hip’s recalled components undergo cross sectional imaging and metal ion testing, even if they are not experiencing pain or other symptoms of hip failure. The most recent recall update posted on Stryker’s website says that some patients who received the Stryker Rejuvenate have experienced adverse tissue reactions and/or high metal ion levels in their blood, even without experiencing any symptoms.*

Additionally, Stryker has partnered with third-party claims administrator, Broadspire Services Inc, to manage reimbursement requests from patients seeking compensation for out-of-pocket costs related to the Stryker Rejuvenate recall.** However, Bernstein Liebhard LLP is advising potential participants of the Broadspire Stryker claims program to seek legal advice before signing any paperwork. Any information disclosed in a Broadspire Stryker claim could be used later as evidence in a Stryker Rejuvenate lawsuit.

Meanwhile, plaintiffs in federally-filed Stryker Rejuvenate lawsuits have motioned to transfer all claims to the U.S. District Court, District of Minnesota. On March 18th, a Brief filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) indicated that Defendants in Stryker Rejuvenate lawsuits have voiced support for the creation of a multidistrict litigation (MDL) for federally-filed claims at this location.
