The San Francisco Employment Attorneys At Blumenthal, Nordrehaug & Bhowmik File A Lawsuit Against ADM on Behalf of Field Case Managers For Alleged Failure To Pay Overtime
Sacramento, California (PRWEB) April 08, 2014 -- The proposed class action lawsuit was filed by the San Francisco employment law lawyers at Blumenthal, Nordrehaug & Bhowmik. The lawsuit, filed on March 25, 2014, alleges that Advanced Disability Management, Inc. ("ADM") misclassified their Field Case Managers and allegedly failed to pay these employees overtime pay and allegedly failed to provide the Field Case Managers with the proper meal periods. The case entitled, Baker, et al. v. Advanced Disability Management, Inc., Case No. 34-2014-00160711 is currently pending in the Sacramento County Superior Court for the State of California. The class action lawsuit claims that the Plaintiff engaged in non-exempt tasks throughout her shift, including reviewing her client's pre-injury position, making appointments with the client's doctors, communicating in-person and by telephone with her clients, employers, medical providers, attorneys, insurance carriers and claims adjustors.
The Complaint further claims that Field Nurse Case Managers should be paid overtime wages because these employees use their RN training to coordinate care, act as intermediaries between patients, adjustors, and doctors and operate in a framework in "which these employees do not exercise ultimate decision making power."
