Webinar from WPL Publishing to Report on New Developments Involving Loss-of-Productivity Disputes in Construction

More and more construction claims are including a loss-of-productivity (LOP) component these days. Too often, though, the claimed amount is not properly substantiated or presented. And LOP often is the reason for other claim elements, such as delay, acceleration, and extended overhead. The 90-minute webinar is designed to help construction professionals gauge an LOP claim’s attributes and drawbacks as well as evaluate other types of claims. The webinar, entitled “Loss of Productivity Disputes -- New Developments on an Expensive and Tricky Issue,” will examine the latest technical and legal concepts associated with loss of productivity along with the following other critical issues:
- What is productivity? Why is it important? How should it be measured?
- What guidelines, methods, and tools are commonly used to measure LOP? When can LOP claims be asserted? What types of documentation should accompany the claim?
- How do the courts and appeal boards view LOP?
- What contractual provisions can be used to present and support LOP claims, and which can be used to rebut them?
- Scheduling, accounting, and false claims as they relate to LOP also will be addressed.
Addressing webinar attendees will be William Ibbs, professor of civil engineering and the leader of the Construction Management program at the University of California at Berkeley. He possesses expertise in the areas of construction and construction claims, particularly cumulative impact of changes, schedule delay and disruption, and loss-of-labor productivity. He and the associates of his firm also have worked on and testified for other construction-related issues, such as professional standard of care, personal injury, false claims, and loss-of-business-value disputes. He has consulted on projects with a total constructed value of $30 billion worldwide, with clients such as Bechtel, Chevron, Obayashi, the U.S. Navy, and various public agencies. A recognized authority in the area of construction change and change management, he has published more than 180 scholarly papers in this area. Much of that work has been adopted by corporations and government agencies as a corporate standard claims manual.
After the presentation, there will be an interactive 10-to-15 minute question-and-answer session addressing relevant topics.
