Dog Bite Attorney Thomas J. Newell Prevails In Personal Injury Claim vs. Landlord

In the Berks County Court of Common Pleas, Orphans’ Court Division, Case #83148, Attorney Newell filed a Proof of Deposit on July 25, 2013 pursuant to the Court Order of Judge Peter W. Schmehl. The Berks County dog attack victim had been sledding in December of 2010 near her home on Birch Street in Reading PA. A neighbor’s pit bull jumped the fence and mauled her.
As described in the plaintiffs’ 8 page Petition for Minor’s Compromise filed of record with the Berks County Court of Common Pleas, the young girl was bitten on her right arm and right leg and treated at Reading Hospital & Medical Center. The doctor cut away the dead tissue and insisted that the PA dog bite victim undergo a series of rabies injections since the pit bull was not up to date on its shots. Attorney Newell investigated the owner of the pit bull and found out that she was an uninsured renter. Thomas J. Newell, Esquire then made a personal injury claim on behalf of his client versus the landlord’s insurance company.
In 2012, the Pennsylvania Superior Court had issued a ruling in the case of Rosenberry v. Evans, 48 A.3d 1255, which made it very difficult for a PA dog bite victim to obtain a recovery versus an out-of-possession landlord. Nonetheless, as Attorney Newell pointed out to Judge Schmehl during the Hearing for the Petition for Minor’s Compromise, he was able to use a legal theory he uncovered from a New Mexico court ruling to argue that the landlord in this case did have some legal responsibility. Ultimately, the landlord’s insurance company agreed to make a $15,000.00 settlement payment.
