TCPA Compliance: Former QuoteWizard Executive Joins Underground Elephant

Formerly of insurance lead aggregator, QuoteWizard.com, Ian coordinated his move with the implementation of the Telephone Consumer Protection Act (TCPA), which goes into affect October 16th.

The Act necessitates that marketing calls using an auto dialer and/or pre-recorded calls to cell phones are required to have explicit and documented prior written consent. The Act also demands written consent for all pre-recorded calls made to residential landlines for marketing purposes. Lead aggregators who use third-party affiliates that violate the act, and their customers, face stiff penalties for each violation.

TCPA penalties range from $500-$1,500 per unsolicited call/message. Actual penalty amounts are determined by the courts, which analyze whether the aggregator “willfully” or “knowingly” violated the TCPA.

Ian Hutchinson joins Underground Elephant, leaving QuoteWizard.com, and will be responsible for management of the Client Services Department, including Underground Elephant’s current base of 4,500 insurance agents.
