Civil Lawsuit Filed Against City of Atlanta and APD Officer by Atlanta Falcons Fan
Atlanta, GA (PRWEB) October 15, 2013 -- Stewart, Seay & Felton Trial Attorneys filed a civil lawsuit in State Court of Fulton County, Georgia on behalf of Bobby Swoope against the City of Atlanta and Atlanta Police Officer Nicholas Mercado. According to court documents, the plaintiff, Bobby Swoope, was tailgating with friends outside of the Georgia Dome on Northside Drive on January 20, 2013 prior to the NFC Championship game between the Atlanta Falcons and San Francisco 49ers for which he had one ticket. He was approached by an individual, later identified as Investigator Nicholas Mercado, who wanted to purchase tickets to the game. Mr. Swoope informed the individual that he only had one ticket which he would be using to attend the game. The same individual then began to engage in conversation with another person, unknown to Mr. Swoope, about purchasing two tickets to the game. Minutes later, a signal was made and Mr. Swoope was arrested and charged with attempting to resell entertainment tickets. Mr. Swoope was eventually acquitted of the charge in Atlanta Municipal Court.
The civil filing (#13EV018259J), filed on September 25, 2013, alleges that the City of Atlanta, which is responsible for the policies, practices, customs and regulations of the Atlanta Police Department, and Officer Nicholas Mercado falsely arrested Mr. Swoope without justifiable ground or cause. The suit also alleges: false imprisonment; malicious prosecution; negligent hiring, training and supervision by the Atlanta Police Department; negligence on behalf of Officer Mercado; and invasion of privacy.
The civil suit is requesting punitive damages for Mr. Swoope’s damages including missing the NFC Championship Game, humiliation, emotional distress, mental anguish and attorney fees.
