Habinsky’s practice focuses on all stages of employment-related arbitrations, mediations and trials before state and federal trial and appellate level courts in New York and nationally. He litigates a broad range of employment-related issues, including claims of employment discrimination, sexual harassment, retaliatory discharge, breach of contract, defamation, unfair competition, theft of trade secrets, and wage and hour disputes.
He also offers experience in employment counseling, management and training. Habinsky has provided employment-related counsel to clients for issues regarding hiring and firing decisions, whistleblower and retaliation issues, disciplinary actions, employee complaints, reasonable accommodation and leave requests, social media issues, and wage and hour laws.
Habinsky has led dozens of internal investigations on behalf of Fortune 500 companies and defended his clients against charges of discrimination filed with the EEOC and other human rights agencies. Additionally, Habinsky has experience in all aspects of collective bargaining, labor negotiations and unfair labor practice disputes.
