(ECi) on MWAi‘s breach of contract claim against OMD and La Crosse, and on MWAi‘s tortious interference with contract and tortious interference with prospective economic advantage claims against ECI and Digital Gateway, Inc. (DGI).
The Delaware Court of Chancery stated that the effect of ECi’s behavior was "to deprive MWA of the business that it anticipated from its exclusive licensing agreement… and that the most striking evidence of bad faith on the part of the ECI parties originated from the principals of ECI and DGI.” The complete court’s opinion and ruling on the case (Court of Chancery of the state of Delaware: C.A.
