Hill & Associates Resolves a Berks County, Pennsylvania Slip and Fall Case for $875,000
Philadelphia, PA (PRWEB) October 24, 2013 -- Hill & Associates, P.C. is pleased to announce an $875,000 settlement in Dougherty v. Fulton Bank, Et. Al., Case No. 2011-3591 (Court of Common Pleas, Berks County, PA).
Hill & Associates, P.C. represented Plaintiff, Ms. Eileen Dougherty against Defendant, Fulton Bank (Case No, 2011-3591). According to the court documents, Ms. Dougherty alleged that she suffered a life changing injury when she slipped and fell on ice that had accumulated in front of the defendant’s place of business from a leaking rain gutter. During the course of litigation, Fulton Bank crossclaimed against Mazakia Concrete Construction, the company responsible for the removal of ice and snow that would accumulate in front of Fulton Bank (Case No, 2011-3591).
According to court documents, Ms. Dougherty approached Fulton Bank on the morning of February 3, 2011 and slipped and fell on the main walkway leading to the bank’s entrance. As a result of the fall Ms. Dougherty suffered a tibia fibula pilon fracture requiring surgery with internal fixation to repair the break. While the surgery was successful, the injuries she suffered resulted in lasting physical limitations.
According to the court documents, Ms. Dougherty testified that she is the mother of three young children and worked full-time as a floor nurse at a local hospital prior to the accident. As a result of her injuries, Ms. Dougherty testified that she is limited to performing sedentary/light duty work and is unable to return to her position as a floor nurse.
Pennsylvania law requires business owners to maintain their property in safe working order for visitors. During discovery representatives for Defendant, Fulton Bank admitted that they knew about the dripping rain gutter and that they failed to provide a warning to notify visitors of the defective condition (Case No, 2011-3591).
Susan B. Ayres, the leader of the Hill & Associates team on this case, was able to negotiate a settlement of $875,000.00 on Ms. Dougherty’s behalf, providing her with the financial support she needs to continue her physical recovery and resolving the case before trial (Case No, 2011-3591).
