Suczynski Defends Woman’s Fourth Amendment Rights in DWI Case
Chapel Hill, NC (PRWEB) October 24, 2013 -- Matthew Suczynski, a North Carolina attorney, has been defending Dorothy Verkerk in a May 2011 incident in which Verkerk was charged with DWI.
Verkerk was arrested and charged with DWI, but a Sept. 2013 ruling by the N.C. Court of Appeals states that the stop may have been an illegal search and seizure that violated her constitutional rights. (Court Case No. COA12-1579).
Suczynski has sought to suppress the evidence police got from Shatley, citing her Fourth Amendment protection from illegal search and seizure. The argument was that Shatley acted as a government officer because he turned on his fire truck lights and siren when stopping Verkerk, and did not have authority to enforce traffic laws. The case is now before the North Carolina Supreme Court to address the constitutional issues raised. Verkerk could go free, or have her conviction reinstated.
