Morgan & Morgan’s Michael Goetz Named to Plaintiffs’ Steering Committee for Byetta, Januvia MDL

The MDL alleges use of one or more of the drugs can cause pancreatic cancer, according to court documents.

In August 2013, the U.S. Judicial Panel on Multidistrict Litigation (JPML) consolidated all federally-filed suits involving the diabetes drugs to the U.S. District Court for the Southern District of California. According to court documents, the plaintiffs in the actions each allege use of one or more of the four drugs caused them or their decedent to develop pancreatic cancer.
Although the JPML is “typically hesitant to centralize litigation against multiple, competing defendants which marketed, manufactured and sold similar products,” according to court records, the panel found the plaintiffs made “highly similar allegations” regarding the four drugs’ management of insulin levels and their alleged predisposition to cause pancreatic cancer. Furthermore, court documents state several plaintiffs took more than one of the drugs, suggesting that “discovery specific to the plaintiffs in those cases will involve many of the same or substantially similar documents and witnesses.”
“We expect to prove that taking these drugs creates a heightened risk of developing pancreatic cancer that doctors and patients were not warned about,” Goetz said. “My goal as part of the plaintiff’s steering committee is to not only work in the best interests of each plaintiff, but to find out exactly what these drug manufacturers knew in connection with the risks posed by their products.”
