The Law Office of Guerra & Farah, PLLC represented a client whose two-year-old son was the victim of a fatal daycare fire. Guerra & Farah’s client was depressed over the untimely loss of his son when he went to visit his ex-girlfriend (his son’s mother) at a bar where she worked as a bartender. According to court documents, as he was leaving the bar, he had an altercation with another patron and dropped his cell phone on the ground.

Court documents state that after he left, a security officer was shot and killed in front of the bar, and their client’s cell phone was found in front of the bar in the same location where the shooting had taken place. The cell phone was identified by his ex-girlfriend as his since the home screen had a picture of their deceased son. He was identified by another security officer as the shooter, and the witness identification led to the subsequent murder charges, according to court documents.

Guerra & Farah’s investigation into the case led them to conclude that while their client may have been present where the murder took place, he couldn’t possibly be the shooter. After 18 months of trial preparations, the case was dismissed on November 5, 2013. (Case #13500094 –State of Texas vs. Castillo, Maurice, the 248th District Court of Harris County)
