Skechers Lawsuit Filed By Wright & Schulte LLC Alleges Massachusetts Woman Suffered Serious Leg Injuries While Wearing Skechers Shape-Ups

Court documents for this Skechers lawsuit (Case No. 3:13-cv-00575-TBR) detail that the plaintiff bought Shape-Ups in April 2010 after being persuaded by various ads that wearing these toning shoes could improve her health. Namely, Skechers ads stated that wearing Shape-Ups could help wearers get in shape, improve their overall muscle tone and improve both their circulation and posture.
The Skechers lawsuit also contends that within two months of buying and regularly wearing Shape-Ups, in June 2010, the plaintiff was walking on a flat surface when the unstable rocker bottom of one of her shoes caused her to twist her right ankle and fall. The fall resulted in immediate, severe leg pain, which led the plaintiff to seek medical care. The diagnosis revealed that the plaintiff had torn multiple tendons in her right leg, and the physician informed her that she would need to undergo surgery and have screws implanted in her injured leg. Despite undergoing surgery and extensive physical therapy, however, the plaintiff still reportedly has limited use of and constant pain in her injured left leg.
Skechers Overstates Shape-Ups’ Health Benefits, Skechers Lawsuits Allege
This case, as well as many other Skechers lawsuits, argues that Skechers has largely overstated the safety of Shape-Ups and that Skechers’ claims about Shape-Ups’ health benefits have not been validated by reliable scientific research. In support of this allegation, court documents cite an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin, which found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf June 2010]
Skechers misleading claims about Shape-Ups’ health benefits have spurred a number of lawsuits against the company and have cost Skechers millions in settlement awards to consumers. In fact, in May 2013, a federal judge approved a $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its ads. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
