A woman in Jefferson County, Texas is suing Texas Windstorm Insurance Association for allegedly failing to properly investigate her insurance claim for windstorm damage to her home, according the complaint from Pollie Lou Dean Beasley vs. Texas Windstorm Insurance Association (Case No. E194-920 in the District Court of Jefferson County 172nd judicial district in Texas). According to the court documents, the plaintiff filed her lawsuit in the District Court of Jefferson County 172nd judicial district on Oct. 24, 2013. The plaintiff has stated that she filed a claim with the insurance provider after her home in Groves was damaged by a strong windstorm that took place on July 2, 2011. The plaintiff also claims that she had windstorm insurance coverage with Texas Windstorm Insurance Association but that the insurer did not properly look into her claim or properly evaluate the damages caused to her home. The complaint also alleges that Texas Windstorm Insurance Association provided the plaintiff with an insufficient amount of money to fix the damages.
According to court documents, the Jefferson County resident is claiming a breach of contract, a breach of good faith and fair dealing, and violations of the Texas Insurance Code and Texas Deceptive Trade Practices Act. She is claiming punitive damages in addition to regular damages.
