In case #13-S-392, Attorney Newell filed a Petition for Minor’s Compromise with the Adams County Court of Common Pleas in Gettysburg PA outlining the facts regarding the April 2011 pit bull attack upon a 6 year old Adams County resident.

The fourteen page legal document described how the child knocked at the neighbor’s front door and heard the defendant homeowner tell her “It is open, come in.” As she began to open the front door, the defendants’ pit bull “Chaos” pushed open the door and bit off her right nostril. The Adams County pit bull attack victim was rushed to Meritus Medical Center in Maryland where surgeons re-attached the severed part of her nose.

During the November 5th hearing before Judge Thomas R. Campbell of the Adams County Court of Common Pleas, Attorney Newell described how his client endured nearly 2 dozen treatment sessions in a hyperbaric chamber. Unfortunately, the damaged portion of the nose died off. The exhibits to the Minor’s Compromise Petition established that the defendants’ homeowner’s insurance company was offering its maximum liability policy limit payout of $300,000.00. The Court Order approved a structured settlement annuity which will pay the Adams County dog bite victim $287,650.00 after deductions for attorney fees, legal costs and medical expenses.
