New York Bus Accident Lawyer Adnan Munawar Comments on Staten Island School Bus Accident
(PRWEB) November 19, 2013 -- CBS Local News reported that around 8 a.m. on October 30th, a black pickup truck broadsided a school bus at the intersection of Preston Avenue and Oakdale Street, causing the bus to overturn. (8 Hurt in School Bus Crash on Staten Island, October 30, 2013). The bus, which was carrying four special needs children between the ages of 5 and 9, ended up on its side after receiving extensive damage. According to the report, the father of the truck was FDNY Captain Gary Cline, who says he was driving his daughter to school at the time of the crash
According to the report, Cline alleges that the school bus failed to stop at a stop sign and that he tried to avoid it. Investigators have not issued any citations and are still determining what happened. According to the article, all parties involved in the accident were taken to the hospital with injuries, some serious, but none considered life threatening. Witnesses to the accident expressed their horror at seeing children pulled from the bus and carried into ambulances as well as their outrage that local authorities had put into place safety measures they alleged to have been demanding for over 12 years. According to the report, witnesses say they have wanted local authorities to make the area a slow zone and install speed bumps, but to no avail. Police allege that speed was not a factor in the accident. All parties were expected to recover and the investigation is ongoing.
“It is always especially heartbreaking to see child victims in vehicle accidents,” said Adnan Munawar, Partner at Munawar & Andrews-Santillo LLP. “It is horrifying to see such young kids suffer injuries and be taken away in ambulances, but at least in this instance it looks like they are going to recover. It would be inappropriate to comment on what caused the accident at this point, while authorities are still investigating, but regardless of who, if anyone, is ultimately to blame, people should take this as a reminder to be more cautions when they are driving, particularly around children. ”
“Although police say that speed was not a factor in this particular accident, additional safety measures may still be a good idea if the allegations are true that the intersection is notorious for speeders or unsafe driving. While the investigation continues, anyone who suffered an injury in the accident would be wise to consult with an attorney. Filing a claim is complicated, and in this instance, where there are multiple parties involved, including a public school bus, knowing what claims to bring against which parties is something best done with the guidance of an expert. Additionally, any parent whose child was injured in an accident should consult an attorney immediately to bring civil claims on their child’s behalf. Children under 18 have most of the same rights as adults in regards to compensation for their injuries, but children cannot file a claim their own. A parent or guardian must file the claim on their child’s behalf. Cases where children are injured are particularly emotional and sensitive, and hiring a compassionate, knowledgeable attorney can at least offer the peace of mind that claims are being pursued correctly and vigorously. While you care for your child, let an attorney look out for your rights and get you the compensation you deserve.”
