On November 14, 2013 a Michigan jury awarded a Macomb county man $84,000 for injuries he sustained in a November 2011 dog bite attack. Eric Steinberg, together with Todd Stearn, represented a DTE Energy employee who was bit by a dog during a dog bite prevention seminar held for lineman and field workers at the DTE Energy warehouse in Mt. Clemens, Michigan.
Mr. Steinberg and Mr. Stearn argued that Cher Car Kennels, and its two main employees - Cheryl Carlson and Lori Webster - were responsible for failing to properly handle their Dutch Shepherd “Rush” during the seminar.
Evidence presented to the jury showed that instead of staying in a designated presentation area, the defendants chose to move their 80-pound dog directly into the crowd of DTE employees. As documented in Case No. 12-1838-NO, at one point, they chose to stop directly in front of the seated Plaintiff. While standing front of him and with the dog’s head near the Plaintiff’s lap, the Defendant aggravated her dog, causing it to bite the Plaintiff’s right hand. Following conservative treatment, the Plaintiff had carpal tunnel release surgery and missed about a month of work.
