Hissey Kientz, LLP reports that the DePuy Orthopaedics division of Johnson & Johnson has agreed to pay at least $2.47 billion to settle thousands of DePuy ASR hip replacement lawsuits, according to an article published on November 19, 2013 in the New York Times. The settlement agreement would resolve approximately 8,000 DePuy lawsuits.*

Johnson & Johnson issued a recall of 93,000 DePuy ASR hip implants worldwide in August 2010, reporting that 12 percent failed within five years.** According to a November 2013 Bloomberg News report, internal Johnson & Johnson documents show that 37 percent of ASR hips failed after 4.6 years. The DePuy ASR failure rate in Australia has climbed to 44 percent within seven years.***

Problems relating to DePuy hip replacement failure can include hip implant loosening, metal poisoning from elevated cobalt and chromium levels, fractures at the site of the implant and dislocation of the hip device. Johnson & Johnson are currently facing approximately 12,000 lawsuits filed in federal courts and state courts in California, Illinois and New Jersey.***

Plaintiffs must have had the ASR hip implanted in the U.S. and had it removed by Aug. 31, 2013 to be eligible for this settlement.
