Wright & Schulte LLC, which is currently investigating potential OxyElite Pro lawsuits on behalf of individuals who suffered liver failure, severe liver injury and non-viral hepatitis allegedly caused by the recalled supplements, is disturbed that the OxyElite Pro recall was expanded in recent days to include yet another version of the so-called “fat-burner” dietary supplements. The U.S. Food & Drug Administration (FDA) announced the original OxyElite Pro recall on November 9th, which according to Wright & Schulte LLC, indicates that sales of this additional product were allowed to continue for days, potentially putting untold numbers of consumers at risk for serious liver injuries.

According to the expanded recall notice issued on November 19, 2013, the additional product -- Raspberry Lemonade OxyElite Pro SuperThermo Powder -- also contains Aegeline, a synthesized version of a natural extract from the Bael tree. Use of the products involved in the OxyElite Pro recall have been associated with serious adverse health consequences, namely serious liver damage or acute liver failure, the notice said.

In an alert posted on its website on November 9th, the FDA warned that at least 56 cases of severe liver injury, liver failure and acute non-viral hepatitis had been associated with use of the OxyElite Pro dietary supplements. These cases included 22 hospitalizations, two patients who required liver transplants and one fatality. At that time, a recall was issued for what the FDA says was all lots and sizes of OxyElite Pro products.

Documents posted on the FDA website also indicate the agency sent a warning letter to USPLabs LLC, the manufacturer of the supplements, pointing out that Aegeline was a new dietary ingredient which lacks adequate information to provide reasonable assurance of safety. The presence of Aegeline in the supplements prompted the FDA to find that OxyElite Pro products were adulterated. The letter also stated that failure to immediately cease distribution of the dietary supplements could result in enforcement action by the agency.

On November 6th, the FDA issued yet another warning to USPLabs, after finding a link between the use of OxyElite Pro products and a number of liver illnesses. Among other things, the letter stated that if USPLabs did not initiate a voluntary OxyElite Pro recall, the FDA could by law order the company to immediately stop distributing the dietary supplements and immediately notify other parties to stop distributing them.

It was then, according to the FDA, that USPLabs issued an OxyElite Pro recall, and agreed to destroy warehouse stocks of the supplement. The agency has advised anyone who used OxyElite Pro to seek medical attention if they experience possible symptoms of liver injury, including fever, fatigue, loss of appetite, nausea, vomiting, abdominal pain, dark urine, clay colored bowel movements, joint pain, yellow eyes, and jaundice.
