Skechers Lawsuits Allege Toning Shoes Caused Arm Fractures
These Skechers lawsuits both allege that the unstable rocker bottom of Shape-Ups caused the plaintiffs to lose their balance, fall and break their arms. Specifically, the two plaintiffs alleging having suffered serious Skechers arm injuries include a North Carolina man who fractured his right arm (case no. 3:13-cv-00443-TBR) and a New Mexico woman who sustained multiple fractures in her right arm (case no. 3:13-cv-00446-TBR).
While both complaints explain the plaintiffs required surgery to treat their Skechers arm fractures, the New Mexico woman also had to have a plate and multiple screws permanently implanted in her right arm to treat the severe physical damage she suffered. Additionally, both plaintiffs had to undergo months of physical therapy in order to try to regain some mobility and strength in their injured arms.
Class-Action Skechers Lawsuit Settled for $40 Million
Both of the Skechers arm injury lawsuits allege that, while ads for Shape-Ups claimed that these toning shoes had a number of health benefits, such as helping wearers get in shape without going to the gym, these claims have not been backed up by credible scientific research.

Skechers misrepresentation of Shape-Ups health benefits has been a major allegation charged in the various lawsuits filed against the company and has cost Skechers millions in settlement awards to consumers. In fact, in May 2013, a federal judge approved a Skechers $40 million settlement in a class-action Skechers lawsuit based on hundreds of thousands of consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its ads. As part of this ruling, the court also found that Skechers is no longer allowed to run ads for its toning shoes.
