Telephone Consumer Protection Act (“TCPA”)
In October of this year, significant changes to the Federal Communications Commission’s (“FCC”) rule implementing the Telephone Consumer Protection Act (“TCPA”) will go into effect, bringing the issue of valid consumer consent to the forefront of the minds of regulators and class action attorneys alike. The new changes will require prior express written consent for all autodialed and pre-recorded telemarketing calls, as well as for text messages sent to mobile phones. The FCC’s rule will also require prior express written consent for all pre-recorded telemarketing calls placed to land lines.
