NAELA Commends Supreme Court’s Decision on DOMA
Washington, D.C. (PRWEB) July 02, 2013 -- The National Academy of Elder Law Attorneys (NAELA) commends the Supreme Court’s decision on the Defense of Marriage Act (DOMA), which will extend the spousal benefits of Social Security and Medicare to many married same-sex couples. Further, long-term care spousal impoverishment protections under Medicaid also will be extended, and legally married, same-sex spouses of deceased veterans will be eligible to receive veterans’ benefits. These four programs provide significant financial security during retirement years or in the event of the death or long-term illness of a spouse. Some may be eligible for retroactive benefits.
“In light of this profound and positive change in public policy, NAELA members stand ready to provide guidance for clients who want to understand how this decision could affect them,” says NAELA President Howard S. Krooks, CELA, CAP.
Now, same-sex married couples will be able to work with Elder Law attorneys to plan for their future with the same programs and rights at their disposal that other married couples have had for years. NAELA members have a broad understanding of the laws affecting Social Security, Medicare, Medicaid, and veterans’ benefits, as well as other areas, such as disability planning, estate planning, tax planning, and trusts.
