Orange County Criminal Attorneys Obtain Case Dismissal for Felony Drug Charges
Newport Beach, California (PRWEB) July 15, 2013 -- According to court documents (Case #13WF1274 Superior Court of California West Justice Center), Attorney Randy Collins obtained a case dismissal for a client facing felony drug charges. Mr. Collins was able to convince the court that the methamphetamines found in his client’s car were not hers and that all charges should be dismissed.
On April 29, 2013, a Westminster resident was arrested for being in violation of sections 11377(a) and 11375(b)(2) of the California Health and Safety Code following an arrest by the local police department. According to court documents, an officer was dispatched to her location in Westminster in response to reports of a loud fight between her and her boyfriend. After interviewing the subjects at the scene, the officer searched the defendant’s vehicle and found a “clear baggie of what appeared to be a crystal-like substance” and a prescription bottle filled with medication and more of the substance.
The crystal-like substance was later determined to be methamphetamines, and the pills were not prescribed to anyone at the scene. Possession of methamphetamines can be a felony and the pills a misdemeanor. If a person is convicted of felony drug possession they can be ordered to serve jail time and/or pay thousands of dollars in penalties.
Due to the fact that Attorney Collins’ client was the owner of the vehicle, she was arrested and charged as though all of the illegal substances were hers. “Since my client was unaware that there were illegal substances in her vehicle, she willingly allowed the police officers to conduct a search, after which she was charged with a felony and misdemeanor. Due to the fact that the vehicle was hers, and the person she was with did not inform the police that the substances were his, she was charged with crimes that she did not commit. Luckily, we were able to convince the court that she was innocent, but she was very lucky. Too often, these situations result in innocent people receiving wrongful convictions shaping their future and opportunities.
