California Motorcyclist Awarded $19,466,000
Los Angeles, CA (PRWEB) July 22, 2013 -- On December 15, 2009, Janusz Zastawnik, while riding his motorcycle, was broadsided by a construction truck, driven by an employee of Asplundh Construction Corporation. According to court documents, he sustained severe crush injuries to his feet and ankles, as well as a fractured hip, fractured knee, fractured ribs, and a liver laceration. He was hospitalized for 33 days.
Unfortunately, Mr. Zastawnik never fully recovered from the injuries sustained in the motorcycle accident and was unable to return to his job as a semi-tractor-trailer driver.
For Janusz Zastawnik and his family these injuries were devastating. After growing up in Communist Poland, Mr. Zastawnik and his wife and daughter moved to the United States and became US Citizens. Janusz was so proud of his U.S. citizenship that one of the first things he did was tattoo an American Bald Eagle on his shoulder.
Mr. Zastawnik always loved the outdoor lifestyle. He rode motorcycles, mountain bikes, camped, and spent weekends in the mountains. He had a strong body and a determined spirit and he used these traits to scale some of California's highest peaks, including Mount Whitney on several occasions. In fact, three weeks before the accident, he summited Mt. Whitney in a snow storm and saved some less experienced mountaineers by guiding them off the mountain to safety.
In addition to leading an active lifestyle, Mr. Z knew the value of hard work and his work ethic was unparalleled. According to co-workers it was not uncommon for him to work 60 hours a week to provide for his family. Yet all that changed in December 2009.
"During trial and throughout this 3 ½ year ordeal, we faced one roadblock after another. I am grateful for the Zastawniks' unwavering trust and courage in seeing this through to trial." said attorney Chuck Koro.
“Through no fault of their own, the Zastawnik family was brought into this nightmare. The jury did the right thing with this verdict and hopefully now Mr. Z will be able to get the surgeries and treatment he desperately needs," said attorney Spencer Lucas.
The jury found the driver of the Asplundh construction truck liable for Mr. Z's life-altering injuries and returned a verdict for virtually everything his lawyers asked for.
