Upon learning that there was allegedly no particular test performed to confirm this condition, Dr. Sone decided to have her undergo a Hystero-Salpingogram on August 21, 2006. The results suggested the presence of either a bicornuate or a sub-septate uterus. An MRI then followed, which revealed a sub-septate uterus. This was the first time that her condition was correctly diagnosed.
Following this, Dr. Jeffrey Klein performed an operative hysteroscopy and resection of the uterine septum on December 1, 2006. Thereafter Ms. Brucato then had a normal delivery of her third child on May 23, 2008, full term and with no deficiencies. If testing and surgery had been performed during the earlier years when Ms.Brucato started consulting with her former physicians, allegedly there would have been a strong propensity that the older children could have been carried to term and would not have undergone premature births and fetal distress. Glen was born severely premature. He was later diagnosed with static encephalopathy (brain injury). Glen also acquired a severe articulation disorder, developmental delays, language, speech and learning disabilities, coordination and motor planning problems and weakness in motor planning, balance and sensory integration. Alyssa was subsequently diagnosed with intrauterine growth retardation, delayed motored skills, developmental delays, impaired memory skills and ADHD.
The court found the former physicians’ alleged failure to perform the appropriate tests to confirm her actual condition below the appropriate standard of care, and there were several opportunities for them to arrive at a sound medical conclusion.
