In the case of Lasey Daniels v. Elena Dekazos [Docket No. ST11CV0434], a 24 year-old waiter broke his arm in a car accident, for which liability was admitted. Although he fully recovered, the humerus fracture required surgical repair and resulted in significant medical expenses and a loss of income.
Plaintiff Lasey Daniels was a front-seat passenger in an automobile that was struck by Defendant Elena Dekazos' vehicle. The Defendant was attempting to make a left turn at an intersection at the time of the collision. The Plaintiff was transported by ambulance to the emergency room and then taken to surgery for repair of a humerus fracture. He was unable to return to work as a waiter for approximately six weeks.
Daniels alleged that Dekazos failed to yield the right-of-way and keep a proper lookout. The Defendant admitted fault, but she disputed the value and severity of the plaintiff's personal injury claim. Dekazos contended that Daniels did not require any long-term medical care and that he had experienced a full recovery.
Daniels claimed $47,000 in past medical expenses and $2,000 in lost wages. After a two-hour deliberation, an Athens-Clarke County jury awarded $240,000 to the plaintiff. The Honorable Charles E. Auslander, III approved the verdict in the Athens-Clarke County, GA State Court.
