On July 5, 2013 the San Francisco employment attorneys at Blumenthal, Nordrehaug & Bhowmik filed a class action Lawsuit alleging that Vivint, Inc. failed to pay their non-exempt employees, who were paid on an hourly basis, the proper amount of overtime compensation and allegedly failed to provide these employees the legally required meal and rest breaks. West vs. Vivint, Inc., Case No. 34-2013-00147707 is currently pending in the Sacramento County Superior Court for the State of California.
According to the class action complaint Vivint, Inc., paid their non-exempt employees a non-discretionary bonus wage based on their performance for the company. The Complaint further alleges that as a matter of law the bonus compensation received by Vivint employees should have been included in the employees hourly rates, before the company multiplied the hourly rates by 1.5 to get the correct overtime rate. As a result of the alleged illegal overtime calculations conducted by Vivint, the lawsuit claims other non-exempt employees who worked for Vivint were not correctly paid all their overtime wages. The Complaint also seeks back pay in regards to missed meal breaks alleging that the company did not have a policy to provide a 30 minute uninterrupted meal break for every five hours of work.
