The 32-year old man had his car's engine still running when troopers arrived at the fast-food restaurant in the Erie County town of Newstead, near Buffalo, New York.
On August 10 at 2 a.m., the troopers woke him up and gave him sobriety tests, which he failed. His blood alcohol content was at 0.14. New York's state legal limit is 0.08. Police charged the man with driving while intoxicated.
