Columbus, OH (PRWEB) August 25, 2013
The vaginal mesh lawsuit lawyers at Wright & Schulte LLC applaud the recent #vaginal mesh settlement of an important vaginal mesh lawsuit that was filed on behalf of a woman who sustained serious injuries, allegedly due to an Avaulta pelvic mesh device manufactured by C.R. Bard, Inc. According to court documents, Bard agreed to the vaginal mesh settlement just as the case was about to go to trial. Had the claim proceeded, it would have been the second bellwether trial in a federal multidistrict litigation established in U.S. District Court, Southern District of Illinois for vaginal mesh lawsuits filed against C.R. Bard. The litigation’s first bellwether trial concluded earlier this month, after an 8-member jury awarded $2 million in damages to a woman who suffered serious transvaginal mesh complications due to an Avaulta Plus device. (In re C.R. Bard Inc. Pelvic Repair System Products Liability Litigation, MDL No. 2187)
While the terms of the transvaginal mesh settlement were not disclosed, the outcome of these cases may bode well for plaintiffs in other #transvaginal mesh lawsuits, as bellwether trials are designed to test the strength of claims in similar cases, according to Wright & Schulte LLC. The Firm is already representing numerous women who have allegedly experienced painful transvaginal mesh complications due to products manufactured by C.R. Bard and other companies. Vaginal Mesh Lawsuit Settlement
According to court documents, the recently settled #vaginal mesh lawsuit was filed on behalf of a North Carolina woman who was implanted with Bard’s Avaulta Solo product to treat her pelvic organ prolapse. The Avaulta device allegedly caused her to suffer serious transvaginal mesh complications, leading to severe, permanent physical and emotional injuries. She further alleged that the device was defectively designed, and accused Bard of failing to warn of the potential risks associated with the mesh. (Queen v. C.R. Bard Inc., 11-cv-00012)
Many of her allegations were similar to those brought forth in the federal litigation’s first vaginal mesh trial, which Bard lost just a week prior. That transvaginal mesh lawsuit was filed on behalf of a woman who was injured by the Bard Avaulta Plus device, and who claimed that the company had knowingly used a plastic resin that was unfit for permanent implantation. According to court documents, the total judgment in that case included $250,000 in compensatory damages and $1.75 million in punitive damages. (Cisson v. C.R. Bard Inc., 11-cv-00195)
That trial marked the third loss in a row for transvaginal mesh manufacturers, and the second loss for C.R. Bard. Last July, the company was ordered to pay $3.6 million to another victim of Avaulta Plus in a case that went to trial in California Superior Court. (Scott v. Kannappan, S-1500-CV-266034-WDE ) In March, the New Jersey Superior Court jury hearing the nation’s first trial of an Ethicon Inc. transvaginal mesh lawsuit awarded more than $11 million to a woman injured by the Gynecare Prolift device. (Gross v. Gynecare Inc., Atl-L-6966-10)
In addition to the C.R. Bard litigation, several other multidistrict litigations are pending in the Southern District of West Virginia for vaginal mesh lawsuits involving other device manufacturers, including:
