West 60th St. Associates LLC, New York Supreme Court, Kings County, Index number 24297/2010. According to the deposition testimony of the parties, as well as the verified pleadings, the incident occurred while plaintiff was installing a security camera inside an elevator of a newly constructed Manhattan high rise building. Plaintiff had been provided a ladder to stand upon while installing the camera. At the time of the accident, plaintiff was using a drill above his head when the ladder wobbled, causing plaintiff to fall approximately 3 to 4 feet to the floor of the elevator. Plaintiff sued the building owner, alleging violations of New York Labor Law Section 240. Plaintiff claimed injuries to his lower back, including a herniated lumbar disc that was ultimately treated with fusion surgery.
This ladder accident case, which was handled by Partner Daniel P. O'Toole and Associate Scott Occhiogrosso, settled on August 26, 2013 before trial for $3.1 million.
