Skechers Lawsuit Contends Allegedly Dangerous Design Causes Multiple Stress Fractures
According to the complaint (Case No. 3:13-cv-00450-TBR), the plaintiff bought her Shape-Ups in 2010. One of the plaintiff’s primary considerations in making this purchase was allegedly the purported health benefits of Shape-Ups that had been touted in the various ads for these toning shoes. Specifically, while Skechers ads claimed that wearing these shoes could improve toning in the legs, buttocks and abdominal muscles, these ads also alleged that regularly wearing Shape-Ups could help consumers improve their circulation and posture.
Court documents go on to explain that, within about one year of regularly wearing Shape-Ups, the plaintiff began experiencing excruciating pain in her right foot. Upon seeking medical care and undergoing x-rays and a CT scan, the plaintiff was told that she had suffered from two stress fractures in her right foot. To treat these stress fractures, the plaintiff was ordered to wear a special shoe on her right foot for about six months.
Once her right foot had healed, however, the plaintiff continued wearing her Shape-Ups because she was unaware of the harm these shoes had allegedly done to her foot. Soon after, the plaintiff was again diagnosed with two additional stress fractures in her right foot and had to wear a cast on her injured for at least six weeks. Despite wearing the case and undergoing physical therapy, however, the plaintiff still reportedly has regular pain in and impaired use of her right foot.
Skechers Lawsuit Settlement: $40 Million Awarded to Consumers
While this Skechers lawsuit alleges that Shape-Ups’ defective design caused the plaintiff’s serious injuries, it also contends that Skechers’ claims about the alleged health benefits of Shape-Ups have not been backed up by reliable scientific research. In fact, an independent study conducted by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf June 2010]
Charges that Skechers’ has overrepresented the safety and effectiveness of Shape-Ups’ have been the basis of thousands of lawsuits and have cost Skechers millions in settlements to consumers throughout the U.S. In fact, in May 2013, a federal judge approved a $40 million Skechers class-action settlement based on more than 500,000 consumer claims that Skechers intentionally misrepresented the health benefits of Shape-Ups in its advertising. In his ruling, the judge also ordered Skechers to stop running misleading ads for its toning shoes.
