Court documents for this case explain that the plaintiff was prescribed Actos in April 2011 for the treatment of his type-2 diabetes. After regularly taking Actos for more than one year, in August 2012, the plaintiff was diagnosed with bladder cancer. Although the plaintiff stopped taking Actos a few months prior to his bladder cancer diagnosis, after this diagnosis, the plaintiff had to undergo extensive medical treatments – including multiple surgeries and chemotherapy – to treat his bladder cancer. According to the complaint, the plaintiff’s use of Actos for more than one year caused him to develop bladder cancer, which has now left him with permanent, severe injuries that will require long-term medical treatments and that will negatively impact the rest of his life.
Research and Warnings about Actos Bladder Cancer
In 2011, the American Diabetes Association published a study regarding the potential link between Actos (generically known as pioglitazone) and the risk of bladder cancer. After reviewing adverse event reports (AER) associated with Actos that had been filed with the FDA between 2004 and 2009, researchers found that there was a statistically significant increase in the risk of bladder cancer when taking Actos for more than 12 months. In the conclusion of this study, researchers stated that, “[i]n agreement with preclinical and clinical studies, AERS analysis is consistent with an association between pioglitazone and bladder cancer. Shortly after the publication of this research, in June 2011, the FDA issued an Actos safety announcement, warning the public that “use of the diabetes medication Actos (pioglitazone) for more than one year may be associated with an increased risk of bladder cancer.” While the FDA ordered Takeda to update the warning labels on Actos medication to include information about the risk of bladder cancer at this time, it also highlighted in its safety announcement that taking Actos for longer periods of time and taking higher doses of the drug could increase the risk of bladder cancer. Specifically, the FDA pointed out that Actos patients who took the drug for longer than 12 months had about a 40 percent increased risk of developing bladder cancer (when compared to individuals not taking Actos).
