The syringes were supposed to be preservative free but allegedly contained a preservative that kills the endothelial cells. When the doctor injected the substance into the patients’ eyes, it allegedly caused them to lose vision in the operated eye, suspected to be caused by the numbing agent. To restore their eyesight, the clients had to have corneal transplants, but the second surgery only partially restored their vision.
When the law firm made a claim on behalf of both clients the insurance company for the compounding pharmacy filed a Declaratory Judgment Complaint, asserting that their coverage was limited.
