C8, a chemical used in the manufacture of Teflon, was discharged from the Washington Works plant for decades. In 2005, DuPont reached a settlement in a C8 class action lawsuit which, among other things, charged the C8 Science Panel with investigating potential links between exposure to the chemical and a number of serious illnesses. In October 2012, the Panel reported that it had established a probable association between C8 exposure and kidney cancer, testicular cancer, thyroid disease, inflammatory bowel disease, preeclampsia, and high cholesterol. The C8 class action lawsuit settlement also stipulated that any individual who had been exposed to C8 contaminated water would be eligible to file a personal injury lawsuit if they developed a disease ultimately determined to be associated with C8 exposure. In order to file an individual C8 lawsuit against DuPont, potential plaintiffs must have been diagnosed with a related disease, and they must have lived in one of six water districts included in the settlement prior to December 3, 2004. Those six water districts are:
• Little Hocking, Ohio
• Belpre, Ohio
• Village of Pomeroy, Ohio
• Tuppers Plains, Ohio
• Lubeck Public Service District, West Virginia
• Mason County Public Service District, West Virginia
Court filings indicate that at least 46 C8 lawsuits have already been filed in the federal litigation underway in Ohio. However, the Class covered by the 2005 C8 lawsuit settlement included upwards of 70,000 people who lived and worked in the mid-Ohio Valley prior to December 3, 2004. As such, it is likely that the number of claims brought in the federal litigation will multiply in the coming weeks and months.
