According to court records, the DePuy ASR hip replacement lawsuit set to go to trial on September 24th was filed on behalf of a Rochester, New York, woman who underwent two hip revision surgeries, allegedly due to the defective design of the ASR hip. While it will be the first DePuy ASR hip replacement lawsuit to head to trial in the federal litigation, two others have already gone before a jury in state courts. One resulted in a verdict in favor of the plaintiff, and an $8.3 million judgment against DePuy Orthopaedics. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a second case tried in Illinois was decided in favor of the medical device manufacturer. (Strum v. According to Bloomberg News, a total of seven DePuy ASR hip recall lawsuits are scheduled to head to trial in the next year. In addition to the case set to get underway next week, trials are scheduled to begin in New Jersey and California state courts in October. A Florida case will go before a jury in November, while a state jury in Chicago is slated to take up a DePuy ASR lawsuit in December. In January, additional trials involving DePuy ASR hip recall claims will begin in New Jersey and California.

Bloomberg News also reported last month that DePuy has discussed paying more than $3 billion to settle the thousands of DePuy ASR hip replacement lawsuits filed against the company. The outcome of the seven trials scheduled to begin between September and January could have a significant impact on settlement negotiations, Bloomberg said.
