Baron and Budd is Encouraged by the First Federal Transvaginal Mesh Lawsuit Verdict
LOS ANGELES (PRWEB) September 11, 2013 -- Baron and Budd is encouraged by the jury decision in the first transvaginal mesh lawsuit that awarded $2 million to a woman, Donna Cisson, who claimed that the manufacturer, C.R. Bard Inc., did not sufficiently warn her about defects in the product that in turn caused her bleeding and significant pain. Donna Cisson claims that she had to undergo two revision surgeries to remove the transvaginal mesh device. Finding that Bard did not adequately warn patients about the design defect in its product, the jury awarded $250 million in compensatory damages and $1.75 million in punitive damages.
C.R. Bard Inc.'s transvaginal mesh device, part of its line of Avualta products, was used to treat pelvic organ prolapse, a condition that may involve urinary incontinence or pain. Inserted surgically, the transvaginal mesh device is alleged to have defects including a high risk for infection, erosion and pain. If patients need to remove the device to remedy the pain, they may find that surgeons have a difficult time fully removing the device.
