The plaintiff suffered neck injuries in a rear-end car accident and filed a personal injury lawsuit (Index No.: 14077/08) to claim compensation for her losses. The law firm was able to obtain the settlement despite the victim being treated for separate neck injuries before and after the incident in question.

Ms. Polizzi's previous lawyer was only able to get her a settlement offer of $125,000.

The Law Offices of Kenneth A. Wilhelm recently settled an auto accident lawsuit (Index No.: 14077/08) for $850,000 out of a $1 million insurance policy. According to court documents, the plaintiff, Mary Polizzi, was a passenger in a motor vehicle that was rear-ended by another driver. The victim had to undergo surgery in her neck and suffered other injuries as well. The lawsuit was filed in the Kings County Supreme Court against defendants Quality Provisions, Inc. and Christopher Glancy.

New York personal injury lawyer Kenneth A. Wilhelm said he is pleased that his law firm obtained this settlement for their client. Ms. Polizzi's previous lawyer was only able to get her a settlement offer of $125,000. Wilhelm said this was a particularly challenging case because Ms. Polizzi had injured her neck for which she was treated right up until the day before the accident in question.

In 1980 – 23 years before the incident in question – she was in a car accident where she had sustained neck injuries. In all, the plaintiff was involved in four different auto accidents, each of them involving a neck injury, Wilhelm said.

"The challenge in this case was to distinguish which of these accidents was the cause of any current neck problems that Ms. Polizzi is having," he said. "We were able to successfully determine those facts and the defendants decided to settle." In addition to the settlement amount, the law firm was also able to reduce amounts that the plaintiff owed for workers' compensation, saving her $83,378, Wilhelm said.

In such cases, medical information and testimony can provide valuable insight, Wilhelm said. "The most experienced attorneys will know precisely how to determine the facts of the case and to establish fault and liability. This can make all the difference between a plaintiff receiving an inadequate settlement and securing fair and full compensation for his or her significant losses."
