Religious entities, often nonprofits, are highly regarded by members of the community. Many hesitate to take a church or synagogue to court because they fear something bad may happen to them or that they would be viewed unfavorably by others.

The New York personal injury law firm of Kenneth A. Wilhelm obtained a 100 percent verdict in a premises liability case (SUPREME COURT | KINGS COUNTY | Index: 26553/2010) against the church of St. Francis of Assisi in Manhattan on behalf of a worker who was injured on church property. According to court documents, the plaintiff, Winston Grant, was walking on the sidewalk in front of the church of St. Francis of Assisi when he fell in a hole and injured his shoulder for which he had to undergo surgery.
Both sides agreed that the case was worth $400,000 only if there was a 100 percent verdict against the church, said New York personal injury lawyer Kenneth A. Wilhelm. "We did achieve the 100 percent verdict against the church of St. Francis of Assisi," he said. The jury returned its verdict on Aug. 2 in this case, according to court documents.
There are several challenges that come with filing a lawsuit against a house of worship such as a church, temple, mosque or synagogue, Wilhelm says. "These are religious entities, often nonprofits, that are highly regarded by members of the community. Many hesitate to take a church or synagogue to court because they fear something bad may happen to them or that they would be viewed unfavorably by others in their communities."
However, Wilhelm says, victims do suffer as the result of negligent property owners, whether they are average people, businesses or religious entities. "Our client fell into a hole when he was on the job, suffered an injury and had to undergo surgery in order to recover. He incurred medical expenses and could not work for a period of time to support his family. These are real losses for which he needed to be compensated."
Wilhelm said that in this case, justice was done. "I'm glad that the jury was able to set aside any personal feelings and look at the facts fairly and objectively. I'm happy that our client was able to receive the compensation he rightfully deserved in this case."
