Bar Fight Ends With Man Run Over By SUV
(PRWEB) September 12, 2013 -- Two men got into a bar fight last week, and one tried to drive away – but instead ended up running the other one down. Legal website Houston Accident Attorneys says the man who tried to flee to safety has grounds to sue for his injuries.
The fight broke out in the wee hours of the morning at Sabor Norteno bar, according to the KHOU News (08.26.2013). One of the two men had had enough, and made a run for his SUV parked outside to get away from the brawl. The other followed him out.
The SUV owner got into his vehicle and started it, but his contender attempted to pull him out – and ended up getting run over.
“You lose the legal high ground as soon as you chase after someone,” said Jennifer Fletcher, a spokesperson for Houston Accident Attorneys, which provides free legal resources and helps accident victims find lawyers. “If you go after someone who's running away, you can't claim self defense.”
The driver didn't make it far, instead hitting a parked car and falling out of his vehicle's open door. Both parties were taken to the hospital with serious injuries, police say.
“The man who was run over is actually the one at fault here,” Fletcher said. “He caused his own injuries, and likely the crash, by attempting to assault the driver in his vehicle.”
Fletcher says the injured driver has grounds to sue for compensation.
“It would be a tough case, with so many complicating factors,” Fletcher said. “But the fact is neither man was badly hurt until the car door accident. No matter what happened before, that assault caused their injuries.”
That means the driver could recoup the cost of his medical bills and damaged vehicle, Fletcher says. “But only if he can convince a jury.”
