Today, Gillware Data Services made available a whitepaper to help their MSPs and VARs become compliant with the most recent changes enacted under HIPAA and commonly known as the Final Rule. Full compliance for effected MSPs and VARs is required by September 23, 2013.

Under the Final Rule, all entities that create, receive, maintain or transmit electronic health records are required to comply with HIPAA. This includes all MSPs and VARs that work with organizations that see patients, store patient healthcare records, destroy patient healthcare files or records, or maintain systems that could potentially access patient healthcare information.

The Department of Health and Human Services has stated penalties for non-compliance can reach $1.5 million per violation.

Most of our partners did not know they were even considered a Business Associate under HIPAA.”

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) specifies standards and requirements relating to the security and use of Protected Health Information (PHI) – medical records. In 2009, the Health Information Technology for Economic and Clinical Health (HITECH) act was passed to expand HIPAA to include electronic health records.

Under the HITECH act, the scope of HIPAA was also expanded to cover business associates. And earlier this year, the U.S. Department of Health and Human Services (HHS) released omnibus regulations under HIPAA, often referred to as the “Final Rule.” The Final Rule was released on January 25, 2013, took effect on March 26, 2013, and compliance is required by September 23, 2013.
