Two Oklahoma lawmakers have joined forces with a firefighters’ organization to issue a constitutional challenge to the state’s new worker’s compensation law. The attorneys at Munawar & Andrews-Santillo, LLP, a firm specializing in worker’s compensation claims has weighed in on the controversy.

According to a report from the Associated Press (Okla. Lawmakers challenge new worker’s comp. law, 9/19/2013), a pair of Oklahoma lawmakers have teamed up with a firefighters’ organization to challenge the constitutionality of Oklahoma’s new worker’s comp law. The worker’s compensation experts at New York City based firm Munawar & Andrews-Santillo LLP issued a statement today weighing in on the controversy.

According to the report, Oklahoma Senator Harry Coates and Rep. Emily Virgin have joined the Professional Firefighters of Oklahoma in issuing a constitutional challenge to a worker’s comp statute that was recently signed into law by Oklahoma Governor Mary Fallin. One disputed provision of the law authorizes employers to charge injured employees for compensation that they received by recouping it from their wages.

Another provision that allows employers to opt out of the administrative system and create their own benefit plan for injured workers is also under fire in the lawsuit.
