Attorney Jon Saia Featured on Cover of 2014 Super Lawyers® Magazine’s Ohio & Kentucky Issue

Super Lawyers® Magazine highlighted Attorney Jon Saia’s battle against the flawed DUI system in the cover story of its 2014 Ohio & Kentucky issue. Mr. Saia, of The Law Offices of Saia & Piatt, Inc., discussed the flaws of sobriety testing.

In its Ohio & Kentucky issue for 2014, Super Lawyers® Magazine featured Ohio OVI Defense Attorney Jon J. Saia on its cover. It also featured a cover story titled “When the Officer Says ‘Step Out of the Car’” (starting on page 12) that delved into the great efforts the lawyer has taken to prove the weaknesses of field sobriety tests and breath tests as DUI or OVI evidence. The magazine feature article linked Attorney Saia’s drive to become a defense lawyer back to an experience had at the age of 8, when he was wrongfully accused of an offense by police. It also discussed various other milestones that helped lead him to his law career, including the influence of his stepfather and time he spent as a foreign exchange student in Denmark, where individual rights were highly valued.

After working in general practice for about a decade, a trial that Attorney Saia lost inspired him to learn everything he could about field sobriety tests, according to the Super Lawyers® Magazine feature story. He read up on studies, became certified in the administration of field sobriety tests and became certified as an instructor for the administration of these tests. He even started holding test demonstrations in which he would gather public officials who made decisions regarding DUI/OVI laws, give them alcohol and then administer field sobriety tests and breath tests on them. One of Mr. Saia’s major accomplishments noted in the article was a case he won in 2011, which made it so that the state must allow challenges to test results. This case win resulted in hundreds of recently purchased breath test machines virtually becoming unusable by the state of Ohio.

The article described Attorney Saia’s argument that field sobriety tests actually have nothing to do with impairment and that even sober people can easily fail these tests. He has also noted other problems with DUI cases today, including inaccurate breath test machines and overly convoluted DUI/OVI laws in Ohio.
